U.S. Government Shutdown Impact on Imports and Exports

 

A government shutdown may begin on October 1, 2023, should current negotiations not progress. Delays can be expected as a result.

 

Imports

 

Customs and Border Protection (CBP) is set to continue normal operations such as cargo processing, security screenings, and collection of revenue. Other Partner Government Agencies (PGA), including the Food and Drug Administration (FDA), Environmental Protection Agency (EPA), and Fish and Wildlife (FWS), are expected to furlough some staff, resulting in potential processing delays.

 

Exports

 

The impact may be more noticeable in exports than imports as, in addition to PGA processing delays, shippers may also face delays in license processing and reviews from the Bureau of Industry and Trade (BIS), Office of Foreign Assets Control (OFAC), the Census and other agencies. Enforcement activity from these agencies is expected to continue.

 

The Federal Aviation Administration (FAA) will continue essential activities like air traffic control services and airport development grants, while the Federal Maritime Commission (FMC) will suspend most activities.

 


TMF at Ports of Los Angeles and Long Beach to Increase 4.0% on November 1, 2023

 

The West Coast MTO Agreement (WCMTOA) today announced that on November 1, 2023, the Traffic Mitigation Fee (TMF) at the Ports of Los Angeles and Long Beach will increase by 4%. The adjustment matches the combined 4% increase in longshore wage and assessment rates recently ratified in the coastwide contract between the International Longshore and Warehouse Union and the Pacific Maritime Association.

Beginning November 1, the TMF will be $35.57 per TEU (twenty-foot equivalent unit) or $71.14 per forty-foot container. The TMF is charged on non-exempt containers. Containers exempt from the TMF include empty containers; import cargo or export cargo that transits the Alameda Corridor in a container and is subject to a fee imposed by the Alameda Corridor Transportation Authority; and transshipment cargo. Empty chassis and bobtail trucks are also exempt.

The OffPeak program provides regularly scheduled night or weekend shifts to handle trucks delivering and picking up containers at the 12 container terminals in the two adjacent ports.

The TMF helps offset the cost of operating extended gate hours. Labor costs are the largest single component of extended gate costs.
